Intruder found in Bombed premises
AN INTRUDER found hiding in the rubble of the bombed premises of SD Kells shop in the town's Market Street, was arrested by police and subsequently jailed for six months at Omagh Court on Tuesday.
26-year-old Derek Dunn, with addresses at the town's Slievecoole Park and Woodside Terrace admitted a charge of attempting to steal from the bomb shelled Market Street site, on September 2nd last.
Dunn, who had an extensive previous record, was concurrently jailed on a number of other local burglaries including a break in at Gormley Newsagent's at Castle Street and stealing property valued at �6,000.
Stolen on that occasion was a safe, containing �4,000, together with a quantity of cigarettes.
He also admitted the theft of various tools, value �1,000 from Omagh Building Supplies, Killybrack Road on July 15th last.
A break in at the Attic Bar, John Street in February, in which cash totalling �570 was stolen, was also admitted by the unemployed man.
Dunn also faced two further charges entering the Mellon Country Inn, Beltany Road, Omagh last July with intent to steal and having implements for use in a burglary on the same date.
Court Magistrate, Bernadette Kelly, told Dunn "You have an absolutely atrocious record".
She added that together with the offences he was now facing, it was impossible to avoid sending him to prison. She also stressed her duty to protect the public.
A Police Inspector told the Court on September 2nd last, police received a report of an intruder in the bombed building of SD Kells and subsequently found defendant hiding in the rubble.
When interviewed, he admitted he intended removing property from the premises.
The Inspector, referring to the Mellon Country Inn incident, said police went to the premises in the early hours of the morning where a burglary was in progress. Defendant and a juvenile were arrested at the scene.
Dunn admitted breaking into the premises to steal alcohol and cigarettes. During an interview he also admitted a number of other burglaries.
Defence solicitor, Michael Fahy, said it was accepted the only penalty which could be imposed was a custodial sentence when viewed against the catalogue of crime and defendant's extensive record for burglary.
He said his client had been abusing solvents for a number of years and under the influence of this any regard for law and order was disregarded.
Referring to the offence at SD Kells, Mr Fahy said it, was the one that caused him the most difficulty.
During interview, he said, defendant had volunteered information which led to him being charged with other offences, which he may have otherwise got away with.
